The utilization of overfishing evaluators through the use of sizes of catches and biological parameters is recommended for countries like Brazil. Based on this, this proposal aimed to carry out an evaluation of overfishing of dusky grouper Epinephelus marginatus in southern Brazil, using size data of specimens from commercial and recreational fishing. Dusky groupers measurements in fish stores and markets in the states of Paraná and Santa Catarina, and monitoring of spearfishing championships were held. Considering: 1 = the percentage of adult fish in catches (larger than L50), 2= the percentage of the sample with great length in the catch, 3= the mega-spawning percentage of catches, we evaluate overfished of this species. A total of 131 samples measured in fish markets, 70 were from the spearfishing (prohibited sale), 16 of gillnet and bottom trawls, and 45 of the hook fisheries. Through a collaborative approach with spearfishing fishermen, information about groupers sizes was available through Facebook, where a total of 38 records were obtained. In spearfishing championships, 51 groupers were measured. As an auxiliary result, we processed 149 species of otoliths for estimates of L∞, K and t0. The estimated ages ranging from 0 to 33, with an average 8 years. The evaluation based on the grouped data size indicated that E. marginatus is a vulnerable stock, due to the constant registration of individuals captured under the L50. In addition, we found low rates of occurrence of mega-spawners, showing that the effects of fishing pressure may be acting on the larger individuals. We believe that these results may help fishery managers in the creation and implementation of new fisheries management of dusky grouper in southern Brazil.
